The PlayGarten, LLC, operating as “The PlayGarten” (“The PlayGarten”, “PlayGarten”, “we” or “us”) is committed to protecting your privacy and safeguarding your personal information.  This Privacy Statement describes how we may collect, use and disclose personal information on our website or mobile applications (“websites”).  This Privacy Statement applies to any personal information we collect or receive about you, from any source.

What personal information do we collect?  To whom do we disclose personal information?

Depending on how you interact with us, we may collect the following categories of personal information about you:

We identify the purposes for which we may collect, use and disclose your personal information at the time that we collect such information.  Such purposes include creating and managing your PlayGarten account, providing and operating our services, completing your transactions, processing waivers, responding to your inquiries, sending administrative announcements, sharing information with you that we think you may be interested in such as promotions, savings and other marketing communications, and internal business purposes such as administering or improving our website and improving your experience at our premises.  We obtain your consent for such purposes at or before the time that we collect, use or disclose your personal information, except where permitted or required by law.

The PlayGarten may share personal information in order to fulfill the purposes that you have consented to. We also may share information about you, including your personal information, with third parties in certain circumstances including:

  • Third Party Service Providers. We may share information with business partners and other third parties, such as promotional partners with whom we partner to offer promotional activities and service providers, who may have access to or need to process your personal information in order to provide us with services. How do we retain and safeguard your personal information?

We retain personal information for as long as necessary to fulfill the purposes for which it was collected and as permitted or required by law.  We have implemented, or intend to implement, physical, organizational, contractual and technological security measures to protect your personal information from loss or theft, and unauthorized access, disclosure, copying, use or modification.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

How do we monitor our websites?

Our websites may place and access cookies when you visit our websites.  A cookie is a small data file that websites commonly write to your computer.  A cookie file contains information that can identify you each time you visit the website.  Our websites use cookies as a way to measure website activity and traffic patterns.  We may use third party vendors and advertising networks to serve advertisements on our websites.  Such third parties may place and access cookies on your browser, including for the purpose of delivering tailored advertisements to you.  That activity is subject to such third parties’ policies and terms.  You may choose to set your computer to reject cookies if you desire.  However, if you refuse to accept cookies, you may not be able to use some of the features available on our websites.

No mobile information (text messaging originator opt-in data and consent) will be shared with third parties/affiliates/business partners for marketing/promotional purposes. The opt-in is not transferable to another party involved in the process.

Do Third Parties Use Cookies or Other Tracking Technologies?

Some content or applications, including advertisements, on the website are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. How can you access your personal information?

We will make available to you any personal information that we have collected, used or disclosed from our website, upon your written request, to the extent permitted by law. We will attempt to respond to your written request within thirty (30) days.  We will advise you in writing if we cannot meet your request within this time limit.

Children’s Online Privacy Protection Act Notification

Our website is not designed or intended for use by children under 13 and we do not collect Personally Identifiable Information from children under 13 via our website. If we discover that a child under 13 has provided us with Personally Identifiable Information, we will delete such information from our systems. If you are under 18, you should use the website only with involvement of a parent or guardian.

Please note that certain features of our websites allow for the posting of testimonials, photos, and videos. If you are posting any materials to our websites (websites we control), you may not post any materials showing or depicting a child unless you are either the parent and/or legal guardian of that child and authorized to post such material.
